Why Every Adult Should Consider a Power of Attorney

A Personal Reflection for Grandpa Journey

A few years ago, I completed my Power of Attorney documents through a lawyer.

At the time, I felt it was one of those “important but uncomfortable” life matters — something many people prefer not to think about.

But as I grow older, I increasingly realize how valuable and necessary these documents really are.

Recently, I decided to refresh my memory about Power of Attorney, not only for myself but also for my readers and friends. Many people have heard the term before, but few truly understand what it means or why it matters — until a family emergency suddenly happens.

What Is a Power of Attorney?

A Power of Attorney (POA) is a legal document that allows someone you trust to make decisions on your behalf if you become unable to do so yourself.

In Ontario, there are generally two main types:

1. Power of Attorney for Property

This allows someone to handle financial and legal matters for you.

Examples include:

  • banking transactions
  • paying bills
  • managing investments
  • selling or managing property
  • handling tax matters

2. Power of Attorney for Personal Care

This allows someone to make healthcare and personal care decisions for you if you are mentally incapable.

Examples include:

  • hospital and medical decisions
  • long-term care arrangements
  • medications and treatment consent
  • nutrition and living arrangements

Without these documents, family members may face major legal obstacles during emergencies.

Why People Need a Power of Attorney

Many people assume:
“My spouse or children can automatically handle everything.”

In reality, that is not always true.

Banks, hospitals, and government institutions often require proper legal authority before allowing another person to act on your behalf.

A POA helps avoid confusion, delays, stress, and family conflict during difficult times.

Example 1: Banking Matters

Imagine an elderly parent suddenly suffers a stroke and becomes mentally incapable.

Bills still need to be paid:

  • mortgage
  • utilities
  • insurance
  • credit cards
  • retirement residence fees

Without a Power of Attorney for Property:

  • family members may not be able to access bank accounts
  • automatic payments may fail
  • financial matters can become frozen temporarily

Obtaining court authority afterward can be expensive, slow, and emotionally draining.

With a properly prepared POA, a trusted family member can immediately step in and manage the situation smoothly.

Example 2: Hospital and Healthcare Decisions

Suppose a person is unconscious after an accident or serious illness.

Doctors may need urgent decisions regarding:

  • surgery
  • medications
  • rehabilitation
  • life support choices
  • long-term care placement

A Power of Attorney for Personal Care provides clarity on:

  • who can legally make decisions
  • the patient’s wishes and values
  • avoiding disagreements among family members

This becomes especially important in today’s aging society.

Example 3: House and Property Matters

Imagine someone develops dementia and must move into assisted living.

The family may need to:

  • sell the house
  • handle insurance matters
  • deal with lawyers and real estate agents
  • maintain the property

Without legal authority, even simple property transactions can become extremely complicated.

A POA can make these transitions much easier and protect family finances.

Lawyer vs. Store-Bought Forms

Today, Power of Attorney forms can sometimes be downloaded online or purchased from office supply stores such as Grand & Toy.

This raises an important question:

Should people simply complete the forms themselves?

Store-Bought or Downloaded Forms

Advantages:

  • inexpensive
  • simple for straightforward situations
  • convenient

Risks:

  • incorrect wording
  • improper witnessing
  • missing important clauses
  • unclear instructions
  • not tailored to family circumstances

A mistake may not be discovered until a crisis occurs.

Lawyer-Prepared Documents

Advantages:

  • professionally drafted
  • tailored to your family and assets
  • legal advice included
  • helps avoid future disputes
  • ensures compliance with provincial law

A lawyer can also explain:

  • when the POA becomes effective
  • limitations and safeguards
  • risks of abuse
  • how to choose the right person

For many families, this professional guidance brings peace of mind.

Choosing the Right Person Matters

Perhaps the most important decision is not the form itself — but who you appoint.

The person should be:

  • trustworthy
  • responsible
  • financially mature
  • calm under pressure
  • willing to act in your best interests

This decision requires careful thought and honest family discussions.

Final Thoughts

None of us likes to think about illness, aging, or incapacity.

But preparing a Power of Attorney is not about expecting the worst.

It is about protecting ourselves and reducing burdens on the people we love.

In many ways, it is an act of responsibility and care for the future.

I am glad I completed mine through a lawyer years ago. Revisiting the topic today reminds me that proper planning is one of the greatest gifts we can leave for our families — not only financially, but emotionally as well.

For readers who have not yet considered a Power of Attorney, this may be a good time to start the conversation.

Grandpa Journey

(Power of Attorney)?

(Power of Attorney for Property)

(Power of Attorney for Personal Care)
